| Manage My REDcard TERMS AND CONDITIONS FOR THE ONLINE PAYMENT SERVICE AND THE ALERTS SERVICE | |
The following are the terms under which Target National Bank ("we," "us," or "our") offers you the ability to view and pay your REDcard Account online (the "Online Payment Service") and to receive email notifications about certain activity on your REDcard Account ( the "Alerts Service").
The terms and conditions of the Online Payment Service and the Alerts Service are in addition to other agreements between you and us, including the applicable credit card Account Agreement. If there is a conflict between the terms and conditions of the Online Payment Service or the Alerts Service and the terms and conditions of any other agreements between you and us as they relate to the Online Payment Service or the Alerts Service, the applicable terms and conditions of the Online Payment Service and the Alerts Service will control.
ONLINE PAYMENT SERIVICE TERMS AND CONDITIONS
1. USE OF THE ONLINE PAYMENT SERVICE. You may use the Online Payment Service to view your REDcard Statement online and to make one-time online payments or preauthorized, recurring payments directly from a checking or savings account located in the United States. Your enrollment does not obligate you to use the Online Payment Service as the only means of paying your REDcard Account.
2. BUSINESS DAYS. Our business days are any day including Saturday and Sunday, except Thanksgiving Day, Christmas Day and New Year's Day. One-time payments authorized after 3:00 PM, Central Time, on any Business Day will not be credited to your REDcard Account until the next Business Day.
3. LIMITATIONS ON FREQUENCY OF TRANSFERS. You will not be able to make payments using the Online Payment Service more than twice in any 7-day period.
4. LIMITATIONS ON DOLLAR AMOUNT OF TRANSFERS. The minimum payment you will be able to make with the Online Payment Service is $1.00. However, if your Current Account Balance is less than than $1.00 we will accept a payment less $1.00 to pay the balance in full. The maximum payment you will be able to make with the Online Payment Service is your Current Account Balance as reflected on the Account Summary page of the Manage My REDcard website.
5. FEES. We will not impose a fee or other charge to use the Online Payment Service. However, the financial institution at which you maintain your deposit account may charge you fees related to the maintenance of that account, including transaction fees or fees for attempting transfers without sufficient funds. As provided in your Target Visa Credit Card Agreement, a charge of $39.00 ($29.00 for some accounts) will be assessed to your Target Visa Account for any payment that is returned unpaid by your bank. As provided in your Target Credit Card Agreement, a charge of $39.00 ($29.00 or $20.00 for some accounts) will be assessed to your Target Credit Card Account for any payment that is returned unpaid by your bank.
6. CONFIDENTIALITY. We will disclose information to third parties about transfers you make with the Online Payment Service: (a) when it is necessary for completing transfers; (b) in order to comply with government agency or court orders; (c) if you give us your written permission; and (d) as otherwise provided in our privacy policy.
7. PREAUTHORIZED, RECURRING PAYMENTS. You have the option of preauthorizing recurring electronic payments from a checking or savings account to your REDcard Account. You may choose to preauthorize recurring payments of your Minimum Payment Due, Fixed Pay or your New Balance as indicated on your monthly statement. By choosing the preauthorized, recurring payments option, payments from your checking or savings account to your REDcard Account will automatically occur each month without further action by you. You must continue to remit your monthly payment until: 1) Your monthly payment remittance slip states "Payment will be Auto Paid." OR 2) You receive notification via the Manage My REDcard Online Payment service that Auto Pay is effective with your current payment due (if you are enrolled in Stop Paper Statement you will not be receiving payment remittance slips but can view your statements online). To revoke your authorization for preauthorized, recurring payments, you must cancel your enrollment in the Auto Pay Service by signing into the Manage My REDcard website from a personal computer, select Payment Information in the left navigation, select Manage Auto Pay, and follow the steps to cancel your enrollment or you can notify us in writing at Target National Bank, c/o Target Credit Services, P.O. Box 673, Minneapolis, MN, 55440-9285.
8. UNAUTHORIZED TRANSFERS. If you believe your password for accessing the Online Payment Service has been lost or stolen or that someone has used or may use the Online Payment Service to transfer money from your deposit account without your permission, notify us AT ONCE by calling us at 1-800-394-1829, or writing to us by signing into the Manage My REDcard website from a personal computer and select Credit Services in the left navigation, select Contact Us and follow the steps provided, or write to us at Target National Bank, c/o Target Credit Services, P.O. Box 1581, Minneapolis, MN 55440-1581.
9. OUR LIABILITY FOR FAILURE TO COMPLETE TRANSACTIONS. If we do not complete a transfer you authorize on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages to the extent required by federal law. However, there are some exceptions. We will not be liable, for instance: (a) if, through no fault of ours, you do not have enough money in your deposit account to make the transfer; (b) if the system was not working properly and you knew about the breakdown when you started the transfer; or (c) if circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken. There also may be other exceptions stated in our agreements with you or provided by applicable law.
10. TERMINATION/CHANGE IN TERMS. We reserve the right, at any time, to cancel the Online Payment Service, make additions or changes to these terms, or to cancel or suspend your use of the Online Payment Service. When required by applicable law, we will provide you with a notice of any addition(s) or change(s).
IN CASE OF ERRORS OR QUESTIONS ABOUT PAYMENTS
MADE WITH THE REDCARD ONLINE PAYMENT SERVICE
KEEP THIS NOTICE FOR FUTURE USE
ALL QUESTIONS ABOUT PAYMENTS YOU MAKE WITH THE REDCARD ONLINE PAYMENT SERVICE (the "Online Payment Service") MUST BE DIRECTED TO US (TARGET NATIONAL BANK) AND NOT TO THE BANK OR OTHER FINANCIAL INSTITUTION WHERE YOU HAVE YOUR DEPOSIT ACCOUNT. We are responsible for the Online Payment Service and for resolving any errors in payments made with your password used to access the Online Payment Service.
We will not send you separate periodic statements listing payments that you make using your password to access the Online Payment Service. The transactions will appear on the statement we issue for your REDcard Account and on the deposit account statement issued by your bank or other financial institution. If you enroll in Stop Paper Statement through Manage My REDcard, you will not receive a paper statement and will need to view your statement through Manage My REDcard. KEEP A RECORD OF THE PAYMENTS YOU MAKE WITH THE ONLINE PAYMENT SERVICE AND CHECK IT AGAINST THE DEPOSIT ACCOUNT STATEMENT YOU RECEIVE FROM YOUR BANK OR OTHER FINANCIAL INSTITUTION. If you have any questions or need more information about one of these transactions, call or write us at the telephone number and address indicated below.
We must hear from you no later than 90 days after your bank or financial institution sent the FIRST deposit account statement on which the problem or error appeared.
(1) Tell us your name and REDcard Account number.
(2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
(3) Tell us the dollar amount of the suspected error.
If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.
We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your deposit account within 10 business days for the amount you think is in error so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your deposit account.
We will tell you the results within 3 business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
IF YOUR PASSWORD FOR ACCESSING THE ONLINE PAYMENT SERVICE IS LOST OR STOLEN, NOTIFY US AT ONCE by calling us at 1-800-394-1829 or writing to us by signing into Manage My REDcard from a personal computer, select Credit Services in the left navigation, select Contact Us and then follow the steps provided or write to us at Target National Bank, c/o Target Credit Services, P.O. Box 1581, Minneapolis, MN 55440-1581.
ALERTS SERVICE TERMS AND CONDITIONS
11. SETTING UP, DELETING AND CHANGING ALERTS. You must be enrolled in Manage My REDcard to sign up to receive email alerts about certain activity on your REDcard Account. You can sign up to receive email alerts by selecting "Set Alerts" on the Manage My REDcard website. When you enroll in Manage My REDcard, we will automatically send some alerts to your email address, such as the alert letting you know your billing statement is available to view online. The Alert Service terms and conditions apply to both the automatic alerts we send you and the alerts you select.
You may delete or change the alerts you select. To stop receiving the automatic alerts you must disable your access to Manage My REDcard.
12. RECEIVING ALERTS. Your alerts, both the automatic alerts and your selected alerts, will be sent to the primary email address on your REDcard Account. You agree to let us know if your email address changes so your email alerts continue to be delivered to you. You understand and agree that the alerts will not be encrypted. You must provide all equipment, software and services necessary to receive alerts.
Alerts will be sent each day when the transaction or event occurs that meets the specific criteria you have chosen. You understand that alerts will be sent at the next scheduled alerts delivery time after the transaction or event occurs. We have the right to change the frequency or timing of the alerts at any time.
You understand and agree that receipt of each alert may be delayed, or prevented by factors affecting your Internet service provider and other relevant entities (each a "Third Party Service Provider"). All issues with a Third Party Service Provider are between you and the Third Party Service Provider. We make no representations or warranties with regard to any Third Party Service Provider's products or services.
We do not guarantee the accuracy or delivery of any alert. We will not be liable for losses or damages arising from (a) non-delivery, delayed delivery, or misdelivery of an alert, (b) inaccurate content of an alert or (c) your use or reliance on the delivery or content of an alert for any purpose.
Alerts do not replace your billing statement or other communications we may provide to you about your Account.
13. TERMINATION OF OR CHANGES TO THE ALERTS SERVICE. The Alerts Service terms and conditions are in effect for the entire time you are enrolled in Manage My REDcard. You understand and agree that we may terminate or change these terms and conditions or the Alerts Service at any time without prior notice to you, but we will notify you as soon as reasonably possible of changes that materially affect your use of the Alerts Service. All applicable provisions of the Alerts Service terms and conditions will survive termination, including without limitation, provisions relating to warranty disclaimers, limitations of liability and indemnification.
GENERAL TERMS AND CONDITIONS OF THE ONLINE PAYMENT SERVICE AND THE ALERTS SERVICE
14. GENERAL USE. You agree not to use the Online Payment Service or the Alerts Service to conduct any business or activity which is prohibited by law or any contractual provision by which you are bound. You agree to comply with all applicable laws, rules and regulations in connection with the Online Payment Service and the Alerts Service. If any provision of these terms and conditions is held to be void and unenforceable, the remainder of the provisions shall remain in full force and effect and shall not be invalidated or otherwise affected.
15. LIABILITY. Except as otherwise provided in the terms and conditions of the Online Payment Service and the Alerts Service or as provided in our other agreements with you or as otherwise expressly provided by applicable law or regulation, you agree that neither we nor any party that provides Internet access or equipment used for the Online Payment Service or the Alerts Service, or any agent, contractor or subcontractor of any of the foregoing, will be liable for any loss, injury or damage, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages, whether under a contract, tort or any other theory of liability, arising in any way out of the enrollment, use or maintenance of the Online Payment Service or the Alerts Service, or of the Internet provider used to access the Online Payment Service or the Alerts Service or the equipment used to access the Online Payment Service or the Alerts Service, including, without limitation, any loss, injury or damage related to any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus, system failure or unauthorized interruption or access to the Online Payment Service or the Alerts Service, even if we or the Third Party Service Provider are aware of the possibility of such events.
16. INDEMNIFICATION. You agree to indemnify, defend and hold us, and our affiliates, officers, directors, employees, agents and service providers harmless from any and all third party claims, liability, damages and/or costs (including, but not limited to reasonable attorneys' fees) arising from (1) a third party claim, action or allegation of infringement, misuse or misappropriation based on information, data, files, or other materials submitted by you to us (2) the performance of the Online Payment Service or the Alerts Service; (3) any fraud, manipulation, or other breach of these terms and conditions by you; (4) any third party claim, action or allegation brought against us arising out of or relating to a dispute with you over the terms and conditions of an agreement or related to the purchase or sale of any goods or service; (5) your violation of any law or rights of a third party; (6) your use, or provision of the Online Payment Service or the Alerts Service or use of your REDcard Account by any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. You will not settle any action or claims on our behalf without our prior written consent.
17. ASSIGNMENT. You may not assign the terms and conditions of the Online Payment Service or the Alerts Service to any other third party. We may assign the terms and conditions of the Online Payment Service or the Alert Service or delegate or transfer our rights and responsibilities under the terms and conditions of the Online Payment Service or the Alerts Service to any third party.
