75% of companies with over $100 million in sales have litigation hold policies.

Smaller companies, with less than $100 million in annual sales, are most worried about regulatory compliance, evolving case law, and statutory requirements.

The CEOs and counsel of larger companies worry most about:

  • quality of their policies
  • enormous costs and burden of electronic discovery.
  • sanctions if they don't get it right

Failure to comply with a discovery request is likely to involve electronic evidence.
